Terms and Conditions: Tek Electrics (2026)
1. Scope of Works and Supply
Service Provision: Tek Electrics (the "Contractor") agrees to supply labor, materials, inspection, and certification services for domestic, commercial, industrial, and educational (schools, academies, colleges) electrical installations, maintenance, and statutory testing as specified in the provided quotation or tender document.
Technical Knowledge & Compliance: All works will be carried out in accordance with the current BS 7671 (IET Wiring Regulations) standards applicable in 2026, the Electricity at Work Regulations 1989, and all relevant Health and Safety Executive (HSE) guidelines.
Variations: Any additional works, hidden defects uncovered during installation/testing, or deviations from the original scope requested by the Customer or required for regulatory compliance will be treated as a variation and will incur additional labor and material charges.
2. Workforce Qualifications, Safety & Accreditations
NICEIC Domestic Installer Registration: Tek Electrics is registered as an NICEIC Domestic Installer. All domestic installations comply fully with Part P of the Building Regulations. On completion of domestic works, compliant installations will be self-certified, and a Building Regulations Compliance Certificate will be issued to the homeowner via the NICEIC portal.
ECS Credentials: All site operatives deployed by Tek Electrics hold valid Electrotechnical Certification Scheme (ECS) cards to verify their professional qualifications, technical competence, and health and safety awareness for commercial and site environments.
Working at Height (IPAF Certification): Where works require the use of Powered Access equipment, Tek Electrics certifies that its operatives are fully trained and hold valid IPAF (International Powered Access Federation) PAL licenses (e.g., Categories 3A and 3B for scissor lifts and boom lifts). The Contractor will ensure all high-level access works strictly comply with the Work at Height Regulations 2005.
Vetting (DBS Checks): For works undertaken in schools, academies, care facilities, or other environments involving vulnerable groups, Tek Electrics guarantees that all deployed personnel hold enhanced Disclosure and Barring Service (DBS) clearances. Proof of clearance can be provided to the Client’s site management upon request prior to commencement.
Site Safety: The Contractor complies strictly with the Health and Safety at Work Act 1974. The Client must disclose any site-specific hazards, site induction requirements, or asbestos registers before work begins.
3. Statutory Asset Compliance & Testing Services (PUWER & LOLER)
Where Tek Electrics is contracted to perform specialized commercial asset management, equipment maintenance, or mandatory testing, the terms are as follows:
PUWER Services (Provision and Use of Work Equipment Regulations 1998):
Tek Electrics provides professional inspection, risk assessment, and electrical maintenance services to ensure the Client’s commercial work equipment and machinery comply with PUWER standards.
Our services focus on ensuring electrical safety, appropriate means of isolation, emergency stop functionality, and control circuit integrity.
The Client retains the responsibility to ensure that machinery is structurally sound and that operators are internally trained on safe machine usage.
LOLER Services (Lifting Operations and Lifting Equipment Regulations 1998):
Tek Electrics provides specialist electrical maintenance, control circuit testing, and breakdown support for lifting equipment (e.g., vehicle hoists, dock levellers, goods/passenger lifts).
Where explicitly booked to perform a statutory LOLER Thorough Examination, inspections will be carried out by a designated competent person in accordance with the legal intervals (typically 6 months for person-lifting equipment/accessories, or 12 months for machinery lifting goods only).
A formal LOLER inspection report highlighting any defects, risks, or necessary actions will be issued to the Client upon completion.
PAT / In-Service Inspection and Testing: Portable Appliance Testing (PAT) will be executed in compliance with the current IET Code of Practice for In-Service Inspection and Testing of Electrical Equipment. The Contractor will provide a comprehensive asset register and pass/fail certification.
4. Quotes, Tenders and Acceptance
Validity: Quotes and commercial tenders are valid for 30 days from the date of issue due to potential fluctuations in wholesale material, plant hire, and fuel costs.
Acceptance: A binding contract is formed only when the Customer provides written acceptance (or an official corporate Purchase Order) and pays any required deposit.
5. Payment Terms
Deposits: For domestic and minor commercial works, a non-refundable deposit of [e.g., 25%] is required upon acceptance to secure project dates and cover initial material procurement.
Interim & Stage Payments: For large-scale commercial, industrial, or educational projects lasting longer than seven days, Tek Electrics reserves the right to submit weekly or milestone-based interim invoices for work completed to date.
Final Payment: The remaining balance is strictly due on completion of the works, or within [e.g., 30 days] for approved commercial credit accounts.
Late Payments: In accordance with the Late Payment of Commercial Debts (Interest) Act 1998, interest will be charged on overdue commercial accounts at a rate of 8% above the Bank of England base rate, alongside statutory compensation fees.
Withholding Certification: Final Electrical Installation Certificates (EIC), Electrical Installation Condition Reports (EICR), NICEIC Domestic Installer self-certifications, LOLER/PUWER statutory inspection reports, and PAT registers will be withheld and legally remain the property of Tek Electrics until the relevant invoices are settled in full.
6. Client & Site Obligations
Access & Continuity: The Client shall provide clear, safe, and uninterrupted access to the property at the agreed times. For schools and commercial premises, this includes ensuring unhindered access to plant rooms, distribution boards, riser cupboards, and machinery scheduled for PUWER/LOLER inspection.
Equipment Readiness for Testing: For LOLER/PUWER testing services, the Client must ensure the machinery is clean, accessible, and not in active commercial use at the scheduled time of inspection. If plant machinery is unavailable through no fault of Tek Electrics, a [e.g., £50 / abortive visit] call-out fee may be applied.
Pre-existing Faults: Tek Electrics accepts no liability for pre-existing faults or non-compliant infrastructure within the Client’s existing system discovered during installation or testing. Rectifying these faults to achieve regulatory compliance will be quoted as an additional variation.
7. Data Protection & Freedom of Information
Data Collection & GDPR: Tek Electrics processes personal and corporate data in accordance with the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018. Data is processed solely for quoting, invoicing, contract delivery, and mandatory asset certification.
Third Parties: Technical data and inspection results will be shared with mandatory regulatory and registration bodies (e.g., NICEIC, NAPIT, or Local Authority Building Control) to fulfill statutory compliance and insurance obligations. Where an immediate danger to health and safety is identified during a statutory LOLER inspection, Tek Electrics has a legal obligation to notify the relevant enforcing authority (HSE or Local Authority).
Public Sector Compliance: Where the Client is a school, academy trust, or local authority, Tek Electrics acknowledges that the Client may be subject to the Freedom of Information Act 2000 and will cooperate reasonably with data requests regarding the contract where legally required.
8. Warranty and Liability
Workmanship & NICEIC Platinum Promise: All domestic and commercial installation labor is guaranteed for [e.g., 12 months] from the date of completion. As an NICEIC registered business, our qualifying domestic work is backed by the NICEIC Platinum Promise, giving domestic clients additional consumer protection insurance up to the statutory limit. Statutory testing services (LOLER, PUWER, PAT) provide a snapshot of safety compliance at the precise date and time of the test; subsequent component failures are excluded from this guarantee.
Materials & Plant Hire: Manufacturers' warranties apply to all supplied commercial switchgear, consumer units, smart controls, and luminaires. If dedicated high-access plant (MEWPs) is hired specifically for the project, any machinery downtime caused by plant mechanical failure is subject to the hire company's standard terms.
Exclusions: This warranty does not cover fair wear and tear, vandalism, accidental damage, environmental factors (e.g., flooding), or unauthorized modifications made by third-party maintenance staff.
Limitation of Liability: To the maximum extent permitted by law, Tek Electrics’ total liability for any commercial loss, business interruption, or damage shall be capped at the total value of the contract.
9. Cancellation & Termination
Domestic Cooling-Off: For domestic contracts signed at a consumer's home, a statutory 14-day cooling-off period applies. If emergency or immediate works are explicitly requested to start within this window, the consumer waives their right to cancel once services are performed.
Commercial Termination: Commercial contracts may be terminated by either party with [e.g., 14 days] written notice. The Client will remain fully liable for all labor hours worked, testing performed, and materials specially ordered or installed up to the point of termination.
